文章从著作权、邻接权、物权确权三方面分析现行法律制度对智慧图书馆中AIGC权利保护存在的不足，基于此，结合AIGC的技术原理、事实属性和价值特征从法理层面确认AIGC的数据财产定位，并提出通过权利主体的确定、权利内容的展开及权利效力的保障构建智慧图书馆中AIGC数据财产权保护的制度框架。

The article analyzes the shortcomings of the current legal system in protecting the rights of AIGC in smart libraries from three aspects: copyright, adjacency rights and property rights confirmation. Based on this, combining the technical principles, factual attributes, and value characteristics of AIGC, the legal positioning of AIGC's data property is confirmed, and system frameworks for protecting AIGC's data property rights in smart libraries are proposed through the determination of the rights subject, the expansion of the rights content, and the protection of the rights effectiveness.
