Abstract

AbstractThe article points out that digital libraries and readers are in a substantially unequal contracting situation, leading to the imbalance of distribution of rights and obligations in registration agreements of digital library. It analyzes and evaluates the content of unfair clauses registration agreements, such as unreasonably increasing reader responsibilities, excluding reader main rights, and unreasonably exempting oneself from responsibility. It also proposes the governance approach of digital library registration agreement involving the governance of blacklists and graylists, the governance of model text of the contract joint governance through multilateral participation mechanisms.
